Mapiripán Massacre Newsletters 2, 5 y 7 Last November the Prosecutor General's Office ordered Army colonel Hernán Orozco to be arrested without bail for allegedly commiting the crimes of conspiracy, ommission in connection with aggravated kidnapping, aggravated homicide and terrorism. A similar measure was taken against brigadier general Jaime Humberto Uscátegui for homicide, aggravated kidnapping, and false representation. The Attorney General's Office, for its part, ordered the dismissal of the commander of the Seventh Brigade (brigadier general Jaime Humberto Uscátegui), a severe reprimand for the acting commander of the Infantry Battalion, lieutenat colonel Hernán Orozco-Castro, and the dismissal of five Army soldiers. One of those involved was acquitted. The criminal case concerning the high-ranking officials involved was referred to the military court by the Superior Judicial Council. However, the Constitutional Court ordered the military criminal proceedings against the two officers dismissed to be declared invalid, on the grounds that they should be tried by an ordinary court. In addition, the two officers concerned were removed from their post by the President of Colombia, in accordance with discretionary powers vested upon him by Decree-Law 1790 of 2000 and Presidential Directive 001 of 17 August 2000. |
