Murder of political leader Bernardo Jaramillo-Ossa

On March 22, 1990, Mr. Bernardo Jaramillo-Ossa was murdered at Bogotá Air Shuttle Terminal. He was a presidential candidate of the Patriotic Union, a political party formed following the 1984 peace agreements. In connection with these events, the Prosecutor General's Office REQUESTED requested the conviction of the brothers Fidel and Carlos Castaño, leaders of the United Self-Defense Groups of Colombia, for this murder. The Office also requested Gustavo Adolfo Mesa-Meneses to be declared guilty. In October 2001, Bogotá Seventh Special Judge sentenced the leader Self-Defense Groups in absentia to 22 years in prison, and Fidel Castaño to 18 years in prison.

Last October the National Human Rights Unit of the Prosecutor General's Office ordered the arrest of the ELN leadership for their direct responsibility in the attack. This judicial decision affects Nicolás Rodríguez-Bautista, alias "Gabino"; Herlinton Javier Chamorro-Acosta, alias "Antonio García"; Víctor Orlando Cubides, alias "Pablo Tejada"; Israel Ramírez-Cepeda, alias "Pablo Beltrán"; Rafael Sierra-Granados, alias "Ramiro Vargas" or "Capitán Franco"; Pedro Elías Cañas-Serrano, alias "Oscar Santos"; and Luis Carlos Guerrero-Cárdenas, alias "Lucho".

Last November the Prosecutor General's Office ordered Army colonel Hernán Orozco to be arrested without bail for allegedly commiting the crimes of conspiracy, ommission in connection with aggravated kidnapping, aggravated homicide and terrorism. A similar measure was taken against brigadier general Jaime Humberto Uscátegui for homicide, aggravated kidnapping, and false representation. The Attorney General's Office, for its part, ordered the dismissal of the commander of the Seventh Brigade (brigadier general Jaime Humberto Uscátegui), a severe reprimand for the acting commander of the Infantry Battalion, lieutenat colonel Hernán Orozco-Castro, and the dismissal of five Army soldiers. One of those involved was acquitted. The criminal case concerning the high-ranking officials involved was referred to the military court by the Superior Judicial Council. However, the Constitutional Court ordered the military criminal proceedings against the two officers dismissed to be declared invalid, on the grounds that they should be tried by an ordinary court. In addition, the two officers concerned were removed from their post by the President of Colombia, in accordance with discretionary powers vested upon him by Decree-Law 1790 of 2000 and Presidential Directive 001 of 17 August 2000.
